Beauty Compass ABN 49654883355 (operates an online platform ("Beauty Compass”) allowing users ("User" or "You") to connect to local business or services through Beauty Compass’s platform including through our website at http://www.beautycompass.com.au and the Beauty Compass iPhone and or Android application or any other platform we may introduce in the future ("Beauty Compass Platform").

The following Terms and Conditions constitute an agreement (the “Agreement”) between you as the User and Beauty Compass (“we”, “us”) and contain the terms and conditions that apply to your access and use to The Services provided by Us through our website or our platforms. By using the platform and/or by registering with us, you signify that you agree with these terms of use, including that you consent to the information practices disclosed in our Privacy Statement which is incorporated herein by reference. If you do not agree to abide by these or any future Terms of Service, do not use or access (or continue to use or access) the Service.

1. GUIDELINES FOR USE

1.1 Beauty Compass provides Services (“the Services”) to Beauty Compass Users (“You”) by creating a platform and directory for connecting users (“Users”) who would like to secure beauty appointments at participating freelance make up artists, third party salons and or spas (“Participating Business” or “Participating Businesses”).
1.2 Users are able to generate an online booking and or online enquiry to their desired participating businesses through the Beauty Compass platform.
1.3 Users of Beauty Compass are not required to register in any form, to use Beauty Compass’s Platform, or to be connected to Beauty Compass listed Participating Businesses. In order to leave feedback however, Users are required to Register with Beauty Compass. For further information about this, please refer to “Feedback” under Clause 8.
1.4 Beauty Compass provides the platform only. Apart from enabling participating businesses to list their services on the platform, and allowing Users to search such participating businesses, Beauty Compass accepts no liability whatsoever for any aspect of the Participating Business and User interaction, including but not limited to the description of goods and services offered, the performance of services and the delivery of goods.
1.5 Beauty Compass has no obligation to any User to assist or involve itself in any way in any dispute between a Participating Business and the User.
1.6 All information related to services to be performed or goods to be provided is supplied by Participating Businesses. Unless expressly stated to the contrary.
1.7 Beauty Compass does not have any ability or responsibility to review, approve or verify any User provided information prior to publication on the Beauty Compass platform.
1.8 You note that the resale, or attempted resale of appointments is prohibited, and is grounds for the removal of your ability to book future appointments through the Beauty Compass platform.
1.9 Beauty Compass may modify this Agreement and/ or the Policies (and update the Beauty Compass pages on which they are displayed) from time to time. A date stamp will be applied at the top of the page, you should therefore check this page regularly.

1.10 If You do not agree with any changes to this Agreement (or any of our Policies), You must cease to use the Beauty Compass website and our service

2. BEAUTY COMPASS SERVICE DESCRIPTION

2.1 The Beauty Compass Service will be reviewed and updated from time to time. In addition to the points set out below, certain portion(s) of the Beauty Compass Service may be separately described on the Beauty Compass Platform.
2.2 To list their services on Beauty Compass, a Participating Business that provides a beauty service either (1) creates an account with Beauty Compass through registering directly through the Website and provide an accurate and complete description of the good to be acquired or service to be provided; or (2) upon being approached by a representative of Beauty Compass, agree via expressed written consent that they (the Participating Business) has read, and agreed upon the Terms and Conditions and Privacy and provide an accurate and complete description of the good to be acquired or service to be provided.
2.3a Participating Businesses are not charged a fee for listing their business with The Beauty Compass at this stage. However the Beauty Compass reserves the right to change this in the future.
2.3b If a User would like to liaise with a Participating Business, for their service(s), they are to contact the Participating Business through the “Contact Listing” platform on the Beauty Compass website; or contact the Participating Business directly using links provided by the Participating Business which will redirect Users to the Participating Business’s website and or booking system.
2.4 To ensure Beauty Compass provides a high level of service, Participating Businesses and or Users are asked to cancel in advance any appointments that they will be unable to honour. Beauty Compass however are not involved whatsoever in the appointment and payment process. Beauty Compass provides a platform only.
2.5 Once a Participating Business has provided the relevant goods or services as agreed upon between the User and the Participating Business, the User must pay the agreed price for the goods or services supplied. It will be material breach of this Agreement if, after a Participating Business has provided the relevant goods or services, that the User fails to pay the agreed price. For further information about this, please read Clause 4.
2.6 Once a transaction is concluded, the User is strongly encouraged to complete a Beauty Compass service review using any feedback features on the Beauty Compass Platform.
2.7 The Beauty Compass Platform may from time to time include location/ map-based functionality. The Beauty Compass Platform may display the location of the Participating Business.

3. BEAUTY COMPASS FEES

3.1 Registering and creating an account with Beauty Compass is free. There is no charge for a Participating Business to list their Services or Products on the Beauty Compass platform, or for other Beauty Compass Users to review content on the Beauty Compass Platform.
3.2 Users who would like to engage Participating Businesses through the Beauty Compass platform are not required to register, and communicating with Participating Businesses are free.

4. PAYMENT OF PARTICIPATING BUSINESSES SERVICES

4.1 Payment of Services by Participating Businesses are in Australian Dollars (AUD).
4.2 If engaged, the User agrees to pay the Participating Business for their service and or product, as agreed between the User and Participating Business.
4.3 You acknowledge that Beauty Compass makes no guarantee to the price displayed on the Beauty Compass website and/or any of its platforms, and acknowledge that pricing listed is to be used as a guide only. It is the Users’ obligation to liaise with the Participating Business to confirm pricing as well as guidelines and terms of the Participating Business.
4.4 You expressly agree that Beauty Compass has no responsibility and makes no warranty as to the truth or accuracy of any aspect of any information provided by Participating Businesses, including, but not limited to, the ability of Participating Businesses’ Workers to perform tasks or supply items, or the honesty or accuracy of any information provided by Participating Businesses or the User’s ability to pay for the services or goods requested.
4.5 You expressly agree that if there is a no show, non-payment issue between the User and the Participating Business, that Beauty Compass will not be involved, and the dispute will be an issue between the User and the Participating Business.

6. LINKS

6.1 This Website, including associated social media profiles, may contain links to third party websites. The inclusion of a link does not imply that the Beauty Compass endorses, has investigated or verified the linked websites.
6.2 Beauty Compass makes no warranty or representation concerning these links or the linked websites and you acknowledge that Beauty Compass is not responsible for the functionality of these links, the security of such websites, the reliability or accuracy of the information contained on such websites, the copyright compliance, legality, decency, privacy policy, privacy practices or any other aspect of such websites.
6.3 You acknowledge that you enter any third party websites at your own risk. It is your responsibility to review any terms of use or privacy policies relevant to such websites.
6.4 All prices displayed of services advertised on the Website, can be changed without notice.

7. USER'S OBLIGATIONS

7.1 You agree that at all times:
(a) You will comply with this Agreement (including all Beauty Compass Policies) and all applicable laws and regulations;
(b) You will post only accurate information on the Beauty Compass Platform;
(c) You will promptly and efficiently perform all your obligations to other Beauty Compass Users and to Beauty Compass under this Agreement; and
(d) all content (whether provided by Beauty Compass, a User or a third party) on the Beauty Compass Platform may not be used on third party sites or for other business purposes without Beauty Compass’s prior permission.
(e) you will not use the Beauty Compass platform for any illegal or immoral purpose.

8. FEEDBACK

8.1 Beauty Compass is entitled to suspend or terminate your account at any time if Beauty Compass, in its sole and absolute discretion, is concerned by any feedback about You, or considers your feedback rating to be problematic for other Beauty Compass Users.
8.2 In order to provide Feedback on a Participating Business a User must register and become a member of Beauty Compass. Further information as to what is collected of members can be viewed on our privacy statement here.
8.3 To continue to improve our Beauty Compass Platform, please let us know of any issue or problem that You experience using a Third Party Service by contacting us here.
8.4 Beauty Compass accepts no responsibility and/or liability for any content posted, submitted, or uploaded by its Users, or for any loss or damage of (not limited to financial and economic loss), nor will the Beauty Compass be liable for any mistakes, defamatory statements, slander, omissions, falsehood or profanity in which you may encounter.
8.5 Beauty Compass acts as a platform only to connect Users with Participating Businesses and will not be liable for any statements (including but not limited to feedback provided by its Users), representations or content submitted by its Users on the Beauty Compass website, and/or any related Beauty Compass platforms, on any public forum, social media platform, personal homepage or any other media platform.
8.6 Beauty Compass has no obligation to review, screen, edit, translate any statements or reviews left by its Users, and reserves the right to publish any reviews left by its Users.
8.7 If a Participating Business feels a review left by a Beauty Compass user is untrue or false, they are to contact Beauty Compass by emailing hello@beautycompass.com.au directly and provide sufficient details entailing reasons why they may feel a review or statement should be removed. Beauty Compass holds and will exercise sole discretion in making final determination regarding whether or not a review or statement should be removed or not, and will not be liable for any loss or damage suffered as a result of not deleting a review left by its User(s).

9. LIMITATION OF LIABILITY

9.1 In no event shall Beauty Compass, nor any of its officers, be liable to you or anyone for any delays, errors, any loss, damage or cost, including, without limitation, any direct, indirect, special, purely economy, consequential or punitive damages or any legal costs arising out of, or in connection:
a.    the use of the Beauty Compass;
b.    the use of information provided by you through for Beauty Compass and or its platforms; or
c.    you or anyone else being unable to access the Beauty Compass for any reason; or
d. the performance or non-performance of any beauty services; or
e. the non-payment or satisfaction of the performance or non-performance of any beauty services.
9.2 You indemnify Beauty Compass against any action, liability, claim, loss, damage, proceeding or expense (including legal costs) suffered or incurred by Beauty Compass, arising out of, or in connection with:
a.    your breach or non-observance of any term of these Terms of Use;
b.    any Content submitted by you; or
c.    any breach or inaccuracy in any representations or warranties made to Beauty Compass by you.
9.3 Beauty Compass, nor any of its officers will be liable to you or anyone for any defamatory, infringing, offensive or material found in connection with the use of Beauty Compass, including such conduct or material transmitted by means by any other person.
9.4 Beauty Compass has no control over, and cannot guarantee the availability of any Participating Business providers at any time.
9.5 Beauty Compass will not be liable for cancelled or otherwise unfulfilled appointments or any injury resulting therefrom, or for any other injury resulting from the use of the Platform or Services whatsoever. We strongly advise that Users conduct their own investigations prior to selecting a Participating Business.

10. NO WARRANTY

10.1 Beauty Compass services are provided on an "as is" basis, and without any warranty or condition, express or implied.

11. NO RELATIONSHIP CONSTITUTED

11.1 No agency, partnership, joint venture, employee-employer or other similar relationship is created by this Agreement. In particular You have no authority to bind Beauty Compass, its related entities or affiliates in any way whatsoever.

12. MEDIATION AND DISPUTE RESOLUTION

12.1 Beauty Compass encourages you as the User to try and resolve disputes (including claims for returns or refunds) with Participating Businesses directly. Accordingly, You acknowledge and agree that Beauty Compass may, in its absolute discretion, provide your information, as it decides is suitable to other parties involved in the dispute.
12.2 If You have a complaint about the Beauty Compass Service, please contact us directly through hello@beautycompass.com.au
12.3 If Beauty Compass provides information of other Beauty Compass Users to You for the purposes of resolving disputes under this clause, You acknowledge and agree that such information will be used only for the purpose of resolving the dispute (and no other purpose) and that you will indemnify Beauty Compass against any claims relating to any other use of information not permitted by this Agreement.

13. TERMINATION OF RELATIONSHIP WITH THE BEAUTY COMPASS

13.1 Either party (Beauty Compass and the Participating Business) may terminate and/or request to terminate their listing at any time for any reason.
13.2 Termination of this Agreement does not affect any Task Agreement(s) formed between Beauty Compass Users. If You have entered a Task Agreement, you must comply with the terms of that Task Agreement including providing the goods or services or paying the price as applicable.
13.3 Third Party Services are subject to Third Party Service provider terms and conditions.
13.4 Sections above related to Beauty Compass Fees), Limitation of Liability, and Mediation and Dispute Resolution and any other terms which by their nature should continue to apply, will survive any termination or expiration of this Agreement.

14. INTELLECTUAL PROPERTY

14.1.    The information, text materials, graphics, logos, button icons, video and audio clips, trade marks (whether registered or not), advertisements, layout, arrangement, graphical user interface, look and feel, and control features of the Beauty Compass Website and or any of its Platforms are protected by copyright, trade mark and other intellectual property laws.
  14.2.    You may not modify, rent, lease, loan, sell, distribute or create derivative works based on any of the Content (either in whole or in part) unless you have been specifically told that you may do so by the Beauty Compass.

15. CHOICE OF LAW AND USE OF THE WEBSITE

15.1 This agreement is governed by the law in force in the State of Queensland and you agree to submit to the non-exclusive jurisdiction of the courts of Queensland, Australia and any other courts which may hear appeals from those courts in respect of any proceedings in connection with these Terms of Conditions or the Website.
15.2 Beauty Compass has designed the Website for use only within the Commonwealth of Australia and makes no warranties or representations with regard to use by persons accessing, downloading or otherwise using the Website outside the Commonwealth of Australia.
15.3 If any of these Terms of Use are invalid or unenforceable, they may be struck out and the remaining Terms of Use will continue to be of full force and effect.

16. LAW ENFORCEMENT

16.1.    The Beauty Compass reserves the right to cooperate fully with any law enforcement authority in any jurisdiction in respect of any lawful direction or request to disclose the identity or other information in respect of anyone posting any materials which violate any applicable or relevant law.

Beauty Compass ABN 49654883355 (“Beauty Compass” or “We” or “Us”) is committed to respecting the privacy rights of our Users, of Participating Businesses who have listed with us, and Visitors. We manage the information that we collect from you in accordance to the standards of the Australian Privacy Principles set by the Australian Government for the handling of Personal Information under the Privacy Act 1988 (Cth) (Privacy Act).
This Privacy Policy applies to all forms of information, physical and digital, whether collected or stored electronically or in hard copy.
We handle Personal Information in our own right and also for and on behalf of Users.
The publication of this Privacy Policy is aimed for the purposes of transparency for our Users and Subscribers and the public to understand what Personal Information is collected and stored, why we do so, how we receive and/or obtain that information, and the rights an individual has with respect to their Personal Information in our possession.
This Privacy Policy has been adopted to ensure that we have standards in place to protect the Personal Information that we collect about individuals and/or Participating Businesses that are necessary and incidental to:
(a) Providing the system and services that Beauty Compass offers; and

By using the Beauty Compass Website, registering with Us, and/or through the use of any of our platforms, you accept the Practices and Policies outlined in this Privacy Policy and you hereby consent that we will track, use and collect the information which you provide to us as outlined herein.

INFORMATION COLLECTED
In the course of everyday business, it is necessary for us to collect Personal Information. This information allows us to identify who an individual is for the purposes of our business, share Personal Information when asked of us, contact the individual in the ordinary course of business and transact with the individual.
  Without limitation, the type of information we may collect is:
(a) Personal Information.  When a User registers with Beauty Compass, we collect personal details such as an individual and/or, a business’s details including: name, or business’s representative’ name, address, mobile number, landline number, email address, and other information defined as “Personal Information” in the Privacy Act;
(b) Statistical Information.  We may collect information about an individual’s online and offline preferences, habits, movements, trends, decisions, associations, memberships, finances, purchases and other information for statistical purposes; and
(c) Information an individual and/or a User sends us.  We may collect any personal correspondence (including but not limited to text material and or pictures) that an individual and/or User sends us, or that is sent to us by others about the individual and/or a Participating Business’ activities.
(d) Public information. We may collect information published on the World Wide Web related to Participating Businesses.
We may collect other Personal Information about an individual and/or Participating Businessl, which we will maintain in accordance with this Privacy Policy.
We may also collect non-Personal Information about an individual such as information regarding their computer, network and browser.  This may include their IP address. Where non-Personal Information is collected, the Australian Privacy Principles do not apply.

HOW INFORMATION IS COLLECTED
Personal Information is collected by the Beauty Compass when Users register (1) their Beauty business with us, or (2) when a User would like to review a Participating Business listed on Beauty Compass. If you have registered with Beauty Compass then your computer or device may store an identifying cookie or anonymous identifier, which can save you time each time you re-visit the Site, by accessing your information when you sign-in to Beauty Compass.

WHEN PERSONAL INFORMATION IS USED AND/OR DISCLOSED
By accessing Beauty Compass, you acknowledge that no compensation is due to you or to anyone for any intentional or unintentional use of personal information you have provided to us.
We will retain Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.
It may be necessary for us to disclose an individual’s Personal Information to third parties in a manner compliant with the Australian Privacy Principles in the course of our business.
Information is used to enable us to operate our business. This may include:
(a) The provision of goods and services between an individual, or business and us;
(b) Verifying an individual’s identity;
(c) Verifying a business’s details;
(d) Communicating with an individual about:
i Their relationship with us;
ii Our services;
iii Our own marketing and promotions to customers and prospects; and
iv Competitions, surveys and questionnaires.
(d) Investigating any complaints about or made by an individual, or if we have reason to 
 suspect that an individual is in breach of any of our terms and conditions or that an 
 individual is or has been otherwise engaged in any unlawful activity; and/or
  (e) As required or permitted by any law (including the Privacy Act); and/or
(f) circumstances pertaining to employment with us; and/or
(g) as a result of a referral from another User of the Beauty Compass.
There are some circumstances in which we must disclose an individual’s information:
(a) Where we reasonably believe that an individual may be engaged in fraudulent, deceptive or unlawful activity that a governmental authority should be made aware of;
(b) As required by any law (including the Privacy Act);
(c) For the purposes of collecting statistical information (which may or may not be used by third parties); and/or
(d) In order to sell our business (in that we may need to transfer Personal Information to a new owner).
We will not disclose an individual’s Personal Information to any entity outside of Australia that is in a jurisdiction that does not have a similar regime to the Australian Privacy Principles or an implemented and enforceable privacy policy similar to this Privacy Policy. We will take reasonable steps to ensure that any disclosure to an entity outside of Australia will not be made until that entity has agreed in writing with us to safeguard Personal Information as we do.
 
THE SAFETY AND SECURITY OF PERSONAL INFORMATION
We will take all reasonable precautions to protect an individual’s Personal Information from unauthorised access.
  The User agrees that the security of online transactions and the security of communications sent by electronic means or by post cannot be guaranteed.  Each individual that provides information to us via the internet or by post does so at their own risk. Beauty Compass cannot accept responsibility for misuse or loss of, or unauthorised access to, Personal Information where the security of information is not within our control.
If an individual suspects any misuse or loss of, or unauthorised access to, their Personal Information, they should let us know immediately.
  We are not liable for any loss, damage or claim arising out of another person’s use of the Personal Information where we were authorised to provide that person with the Personal Information.

HOW TO ACCESS AND/OR UPDATE INFORMATION
Subject to the Australian Privacy Principles, an individual has the right to request from us the Personal Information that we have about them, and we have an obligation to provide them with such information within 28 days of receiving their written request.
If an individual cannot update his or her own information, we will correct any errors in the Personal Information we hold about an individual within 7 days of receiving written notice from them about those errors.
It is an individual’s responsibility to provide us with accurate and truthful Personal Information. We cannot be liable for any information that is provided to us that is incorrect.
You transmit your personal information to us at your own risk.
We may charge an individual a reasonable fee for our costs incurred in meeting any of their requests to disclose the Personal Information we hold about them.

PRIVACY CONCERNS OR COMPLAINTS
If an individual has concerns on how we handle their Personal Information, they should address their complaint in writing to us via filling out our contact form/via our email with the subject.
If Beauty Compass have a dispute regarding an individual’s Personal Information, we both must first attempt to resolve the issue directly between us.
If Beauty Compass becomes aware of any unauthorised access to an individual’s Personal Information we will inform them at the earliest practical opportunity once we have established what was accessed and how it was accessed.
Beauty Compass may, from time to time, modify this Privacy Policy (and update the web page on which it is displayed). In doing so, Beauty Compass will update the “last modified date” at the beginning of this policy, you should therefore check it regularly.

ADMINISTRATIVE COMMUNICATIONS
From time to time, Beauty Compass reserves the right to send an individual and/or Participating Business important notices, such as changes to our terms, conditions and policies. Because this information is important to the individual’s interaction with us, they may not opt out of receiving these communications.
If a User would like to opt out of this communication, they must close down their Beauty Compass account.

ADDITIONS TO THIS POLICY
We reserve the right to make changes to this Privacy Policy, we will post the changes on our webpage at BeautyCompass.com.au and Users will be able to view the last revised date of the Policy. Please refer back to this Privacy Policy to review any amendments.
We may do things in addition to what is stated in this Privacy Policy to comply with the Australian Privacy Principles, and nothing in this Privacy Policy shall deem us to have not complied.
